How it is calculated

Gratuity = 15 × last monthly salary × years of service ÷ 26

Salary here means your last drawn basic pay plus dearness allowance, not your full CTC. The formula gives 15 days of pay for each completed year, counting 26 working days in a month. This is the formula for employers covered by the gratuity law.

In general you become eligible after 5 years of continuous service with the same employer, and a final part-year of more than 6 months is counted as a full year. The law also sets a maximum amount, and the rules for fixed-term staff differ, so confirm the details with your employer.

Good to know

  • Gratuity uses basic pay plus DA only, so a pay structure with a low basic gives a lower gratuity.
  • Check your service length carefully: a few extra months can add a full year to the calculation.
  • Gratuity is paid by the employer and is separate from provident fund.

Common questions

Which salary is used for gratuity?

Only the last drawn basic salary plus dearness allowance. HRA, bonus and other allowances are not included.

How many years do I need to get gratuity?

In general 5 years of continuous service with one employer. The 5-year condition does not apply in case of death or disablement, and different rules can apply to fixed-term employees.

How are months counted?

For employers covered by the law, a final part-year of more than 6 months is rounded up to a full year. So 10 years and 7 months counts as 11 years; 10 years and 5 months counts as 10.

Is gratuity taxable?

Gratuity is exempt from income tax up to a limit set by the government; any amount above the limit is taxed as salary. Government employees have a full exemption.

Is gratuity part of CTC?

Many employers show a yearly gratuity amount inside CTC, but you only receive it when you leave after becoming eligible.
